Terms and Conditions of Sale and Website Use

1. Introduction

These Terms and Conditions govern your use of the Equiball website, the purchase of products from Equiball Ltd, and, where applicable, the relationship between Equiball and its authorised retailers, distributors and trade customers.

Our aim is simple: to provide innovative, high-quality equine products that support horse health, wellbeing, rehabilitation and performance, whilst delivering exceptional customer service and building long-term relationships based on trust, transparency and integrity.

By accessing our website, placing an order, opening a trade account or purchasing any Equiball product, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you should not use our website or purchase products from us.

These Terms have been prepared in accordance with applicable legislation within the United Kingdom and are intended to provide clear guidance for both consumer and business customers.


2. About Equiball

Equiball Ltd designs, develops and supplies innovative equine products for riders, horse owners and equestrian professionals throughout the United Kingdom and internationally.

Since launching in 2022, Equiball has worked alongside equestrian retailers, equine veterinary physiotherapists, body workers, therapists, rehabilitation specialists and horse owners to develop products that genuinely improve equine wellbeing, recovery and performance.

Our products are trusted by professionals and horse owners across multiple countries and continue to evolve through research, customer feedback and practical experience within the equestrian industry.

4. Definitions

For the purposes of these Terms:

Business Customer
means any company, partnership, sole trader, charity, public body or organisation purchasing products for business purposes.

Consumer
means an individual purchasing products wholly or mainly for personal use.

Customer
means any person or organisation purchasing products from Equiball.

Goods
means any products supplied by Equiball.

Website
means www.equiball.com.

Trade Account
means an account approved by Equiball for wholesale purchasing.

Authorised Retailer
means a retailer approved by Equiball to stock and sell Equiball products.

Working Day
means Monday to Friday excluding public holidays in England.

6. Acceptance of these Terms

By using our Website or purchasing products from Equiball you confirm that:

  • you have read these Terms;
  • you understand these Terms;
  • you agree to be legally bound by these Terms;
  • you are at least 18 years of age or have the permission of a parent or legal guardian;
  • where purchasing on behalf of a business, you have authority to bind that business to these Terms.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Equiball reserves the right to amend these Terms from time to time. The latest version will always be published on our Website.


7. Commitment to Quality, Safety and Horse Welfare

Equiball is committed to designing and supplying products that are safe, reliable and fit for their intended purpose.

All products are developed using careful design processes, quality materials and appropriate testing before being released for sale.

We are committed to complying with all applicable UK product safety legislation, including the General Product Safety Regulations 2005, together with any subsequent legislation that replaces or supplements those Regulations.

Where appropriate, we monitor customer feedback, product performance and manufacturing processes to continually improve the quality and safety of our products.

Equiball products are intended to support equine exercise, wellbeing, rehabilitation and performance.

They are not medical devices and should not be considered a substitute for veterinary diagnosis, treatment or professional advice.

Where a horse is suffering from illness, lameness or injury, customers should seek advice from a qualified veterinary surgeon before using any Equiball product.

Customers are responsible for ensuring that products are used safely, appropriately and in accordance with any instructions supplied.

8. Products and Intended Use

Equiball designs and supplies products intended to support equine exercise, wellbeing, rehabilitation and performance. Our products are developed through ongoing collaboration with horse owners, equestrian professionals, equine veterinary physiotherapists, body workers, rehabilitation specialists and authorised retailers.

Whilst every effort is made to ensure that product descriptions, specifications, images and guidance are accurate, products may vary slightly due to manufacturing improvements, material availability or product development.

All dimensions, colours, weights and specifications are approximate unless expressly stated otherwise.

Equiball reserves the right to improve, modify or discontinue products without prior notice where this enhances product quality, safety or performance.

Products must only be used for their intended purpose and in accordance with any instructions supplied.

Customers are responsible for ensuring that products are suitable for their horse, environment and intended application.

Misuse, modification, abuse or use contrary to Equiball's guidance may invalidate any warranty and may reduce product performance or safety.

Equiball products are designed to support horse welfare but should never replace professional veterinary diagnosis, treatment or rehabilitation programmes where these are required.


9. Product Information

We take great care to ensure that all information published on our website is accurate.

Although every effort is made to present products accurately, colours may vary depending on screen settings and photography.

Equiball reserves the right to correct any typographical errors, pricing errors or inaccuracies without liability.

Publication of a product on our website does not guarantee permanent availability.


10. Placing an Order

Orders may be placed through:

• Telephone (where available)

• Email (trade customers only unless otherwise agreed)

• Authorised distributors

When placing an order, customers confirm that:

• all information supplied is accurate;

• they are authorised to use the payment method provided;

• they are legally entitled to enter into a binding contract.

An order acknowledgement confirms only that we have received your order.

A contract is formed only when Equiball accepts the order and dispatches the Goods or confirms acceptance in writing.

We reserve the right to refuse or cancel any order where:

• stock is unavailable;

• payment cannot be authorised;

• pricing errors have occurred;

• fraudulent activity is suspected;

• export restrictions apply;

• we reasonably believe the order breaches these Terms.

If payment has already been taken for a cancelled order, a full refund will be issued using the original payment method.


11. Pricing

All prices displayed on the Website are shown in Pounds Sterling (£) unless otherwise stated.

Where applicable, VAT will be shown separately during checkout.

International customers are responsible for any import duties, customs charges, taxes or local fees imposed by their country.

Prices may change without prior notice.

Price changes will not affect orders that have already been accepted.

Whilst every effort is made to ensure pricing accuracy, Equiball reserves the right to correct genuine pricing errors.

Where a pricing error affects an order already placed, customers will be offered the opportunity to:

• proceed at the correct price;

• amend the order; or

• receive a full refund.


12. Payment

Payment must normally be received before goods are dispatched unless an approved trade credit facility has been agreed.

We accept payment using approved payment providers available through our Website.

Trade customers may be offered credit facilities following a successful application and subject to satisfactory credit checks.

Unless otherwise agreed in writing:

• invoices are payable within the agreed payment period;

• overdue balances may result in suspension of further deliveries;

• Equiball reserves the right to charge statutory interest and compensation on overdue commercial accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Any costs reasonably incurred in recovering overdue debts may be added to outstanding balances where permitted by law.


13. Trade Accounts

Equiball welcomes applications from retailers, distributors and equestrian businesses wishing to become authorised trade partners.

Approval of a Trade Account remains entirely at the discretion of Equiball.

Applicants may be asked to provide:

• registered business details;

• company registration information;

• VAT registration (where applicable);

• trade references;

• website and retail information;

• proof of trading history.

Opening a Trade Account does not guarantee exclusive supply rights within any geographic area.

Trade pricing, promotional support and account benefits remain confidential and must not be disclosed without Equiball's written permission.

Equiball reserves the right to suspend or terminate any Trade Account where:

• invoices remain unpaid;

• products are sold in a manner that damages the Equiball brand;

• counterfeit or modified products are associated with the retailer;

• these Terms are breached;

• fraudulent or unlawful activity is suspected.


14. Retention of Title

Ownership of all Goods supplied by Equiball shall remain with Equiball until payment has been received in full for all sums due under the relevant invoice.

Until ownership transfers:

• the Customer shall store the Goods separately where reasonably practicable;

• the Goods shall remain identifiable as Equiball property;

• the Customer shall take reasonable care of the Goods;

• the Customer shall not remove, alter or obscure any identifying labels or markings.

If payment becomes overdue or the Customer enters insolvency proceedings, Equiball reserves the right, where permitted by law, to recover any Goods for which payment has not been received.

Risk in the Goods passes to the Customer upon delivery, but legal ownership remains with Equiball until payment has been made in full.


15. Recommended Retail Pricing

Equiball may publish Recommended Retail Prices ("RRPs") for the benefit of retailers and customers.

RRPs are provided as guidance only and do not constitute fixed resale prices.

Retailers remain free to determine their own selling prices in accordance with applicable competition law.

Equiball reserves the right to review trading relationships where pricing practices materially damage the reputation, positioning or perceived value of the Equiball brand.

Authorised retailers are expected to present Equiball products professionally and accurately and to represent the brand in a manner consistent with its reputation for quality, innovation and customer service.

16. Delivery

Equiball aims to dispatch all in-stock orders promptly and to provide customers with an efficient and reliable delivery service.

Estimated delivery times displayed on our Website are provided for guidance only and are not guaranteed unless expressly agreed in writing.

Delivery times may vary due to:

  • Stock availability
  • Courier performance
  • Weather conditions
  • Customs procedures
  • Public holidays
  • Circumstances beyond our reasonable control

Where delays occur, we will make reasonable efforts to keep customers informed.

Unless otherwise agreed, delivery shall be deemed complete when the Goods are delivered to the delivery address provided by the Customer.

Customers are responsible for ensuring that delivery details are accurate at the time of ordering.

If a delivery cannot be completed due to incorrect information provided by the Customer, any additional delivery costs may be charged before redelivery.


17. Risk and Ownership

Risk in the Goods passes to the Customer once the Goods have been delivered to the delivery address.

Ownership of the Goods shall remain with Equiball until payment has been received in full in accordance with Section 14 (Retention of Title).

Customers should inspect all deliveries upon receipt.

Any visible damage, shortages or incorrect Goods should be reported to Equiball within five (5) Working Days wherever reasonably possible.

Failure to notify us promptly will not affect statutory consumer rights but may affect our ability to recover losses from the courier.


18. International Orders

Equiball supplies customers throughout the United Kingdom and internationally.

International deliveries may be fulfilled from:

  • United Kingdom distribution facilities
  • Approved international fulfilment centres
  • Authorised regional distributors
  • Other approved logistics partners

Customers are responsible for ensuring that products may legally be imported into their country.

Import duties, customs charges, VAT, local taxes and clearance fees are the responsibility of the Customer unless expressly stated otherwise before purchase.

Delivery times for international shipments may be affected by customs clearance procedures and local carrier operations.

Equiball cannot accept responsibility for delays caused by customs authorities or border inspections.

Where products are supplied from an international fulfilment centre, local delivery providers may be used to complete final delivery.


19. Returns and Cancellation Rights (Consumers)

Nothing within these Terms affects a Consumer's statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations.

Consumers purchasing online generally have the right to cancel their order within fourteen (14) days of receiving the Goods without giving a reason.

To exercise this right, Customers should notify Equiball in writing before the cancellation period expires.

Returned Goods should:

  • be unused due to hygienic reasons;
  • be returned complete with original packaging where practical;
  • include any accessories supplied.

Refunds will normally be processed within fourteen (14) days of receiving the returned Goods or satisfactory evidence that they have been returned.

Customers remain responsible for taking reasonable care of Goods whilst in their possession.

Certain products may be exempt from cancellation rights where permitted by law, including personalised or bespoke products.


20. Faulty, Damaged or Incorrect Goods

If Goods arrive damaged, faulty or incorrect, Customers should contact Equiball as soon as reasonably possible.

Where appropriate, we may request:

  • photographs;
  • batch numbers;
  • proof of purchase;
  • further information to assist our investigation.

Where a genuine fault is confirmed, Equiball will, at its discretion and in accordance with applicable consumer law:

  • repair the product;
  • replace the product;
  • provide a refund;
  • offer another appropriate remedy.

Nothing within these Terms limits any statutory rights available to Consumers.


21. Trade Returns

Trade Customers should inspect all deliveries immediately upon receipt.

Any shortages, damages or delivery discrepancies should be reported within five (5) Working Days.

Returns from Trade Customers require prior written authorisation from Equiball.

Unless otherwise agreed:

  • products must be returned unused;
  • products must be in resaleable condition;
  • original packaging should be intact.

Equiball reserves the right to apply a reasonable restocking charge for returned Goods that are not faulty.

Special-order, bespoke or discontinued products may not be eligible for return.


22. Product Warranty

Equiball stands behind the quality of its products.

Subject to these Terms, we warrant that our products will be free from defects in materials and workmanship under normal and intended use.

This warranty does not cover:

  • normal wear and tear;
  • wear of colouring
  • cosmetic deterioration through normal use;
  • accidental damage;
  • misuse;
  • modification;
  • incorrect storage;
  • use contrary to supplied instructions;
  • commercial misuse beyond intended application.

Where a warranty claim is accepted, Equiball may choose to:

  • repair the product;
  • replace the product;
  • provide an equivalent product;
  • provide a full or partial refund where appropriate.

Proof of purchase may be required before any warranty claim can be processed.


23. Product Safety and Intended Use

Horse welfare remains central to everything we do.

Equiball products are designed to support equine wellbeing, rehabilitation, exercise and performance when used correctly.

Customers remain responsible for ensuring products are appropriate for their horse and intended use.

Products should always be used in accordance with any instructions supplied.

Where a horse has an existing injury, illness or veterinary condition, Customers should seek advice from a qualified veterinary surgeon or suitably qualified equine professional before using any Equiball product.

Products should be inspected regularly for signs of wear or damage.

Any product showing signs of deterioration that may affect safety should be withdrawn from use immediately.

Equiball continually reviews product performance and customer feedback to improve product quality and safety.


24. Product Recall Procedure

Whilst every effort is made to ensure product quality and safety, Equiball maintains procedures to respond promptly should a product safety concern ever arise.

Where a product recall or safety notice becomes necessary, Equiball may:

  • contact registered customers directly;
  • publish notices on the Equiball website;
  • notify authorised retailers and distributors;
  • work with relevant regulatory authorities where required.

Customers are encouraged to register purchases where applicable and keep proof of purchase to assist with future communications.

Equiball maintains appropriate product traceability procedures to support effective quality assurance and product recall management where necessary.

 

25. Intellectual Property

All intellectual property rights relating to Equiball products, branding and content remain the exclusive property of Equiball Ltd unless otherwise stated.

This includes, but is not limited to:

  • The Equiball® name and logo
  • Product names
  • Product designs
  • Product concepts
  • Website content
  • Photography
  • Videos
  • Instruction manuals
  • Graphics
  • Marketing materials
  • Product descriptions
  • Technical drawings
  • Training resources

Nothing within these Terms grants any licence or ownership rights to any intellectual property belonging to Equiball.

Customers may download or print website content solely for their own personal, non-commercial use.

Authorised retailers may use approved Equiball marketing materials for the purpose of promoting genuine Equiball products, provided they are not altered without prior written consent.

No person or organisation may reproduce, copy, modify, distribute, publish or commercially exploit any Equiball intellectual property without our prior written permission.


26. Website Use

Users agree to use the Equiball Website responsibly and lawfully.

You must not:

  • use the Website for unlawful purposes;
  • attempt to gain unauthorised access to our systems;
  • interfere with the security or operation of the Website;
  • upload malicious software or viruses;
  • scrape, copy or harvest content without permission;
  • impersonate another individual or business;
  • knowingly provide false information.

Equiball reserves the right to suspend or terminate access to the Website where misuse is suspected.


27. Privacy and Data Protection

Equiball respects your privacy and is committed to protecting your personal information.

We process personal data in accordance with:

We do not store customers' full payment card details.

Personal information is used only for legitimate business purposes including:

28. Marketing Communications

Customers may choose to receive news, product updates and promotional communications from Equiball.

Marketing communications will only be sent where permitted by law or where appropriate consent has been obtained.

Customers may unsubscribe at any time using the unsubscribe link included within marketing emails or by contacting Equiball directly.


29. Limitation of Liability

Nothing within these Terms excludes or limits liability where such exclusion would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded;
  • any statutory rights available under UK law.

Subject to the above:

Equiball shall not be liable for indirect or consequential losses including:

  • loss of profit;
  • loss of business;
  • loss of opportunity;
  • loss of goodwill;
  • loss of anticipated savings;
  • business interruption,

except where such liability cannot legally be excluded.

Customers are responsible for ensuring products are suitable for their intended purpose and used in accordance with all instructions supplied.

Equiball products are designed to support equine wellbeing but cannot guarantee specific performance, rehabilitation or competition outcomes, as these depend upon numerous factors beyond our control.


30. Force Majeure

Equiball shall not be liable for delays or failure to perform obligations where such delay or failure results from circumstances beyond our reasonable control.

These may include:

  • severe weather;
  • flooding;
  • fire;
  • pandemic or epidemic;
  • industrial action;
  • shortages of raw materials;
  • transport disruption;
  • customs delays;
  • cyber incidents;
  • acts of government;
  • war;
  • terrorism;
  • natural disasters.

Where such circumstances occur, we will make reasonable efforts to minimise disruption and resume normal operations as quickly as practicable.


31. Product Improvements

Equiball continually invests in research, innovation and product development.

We reserve the right to improve, modify or discontinue products at any time without prior notice where such changes enhance quality, safety or performance.

Reasonable design improvements shall not constitute defects.


32. Sustainability

Equiball is committed to operating responsibly and continually seeks opportunities to improve the sustainability of its products, packaging and business operations where practical.

We will continue to review manufacturing processes, packaging materials and logistics to reduce environmental impact whilst maintaining product quality and durability.


33. Termination

Equiball reserves the right to terminate or suspend:

  • Website access;
  • Trade Accounts;
  • Distributor Agreements;
  • Retailer relationships;

where these Terms have been materially breached.

Termination shall not affect any rights or obligations that have arisen prior to termination.

Outstanding invoices remain payable following termination.


34. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.


35. Entire Agreement

These Terms, together with our Privacy Policy, Returns Policy and any additional written agreements entered into between Equiball and the Customer, constitute the entire agreement between the parties relating to the supply of Goods and services.


36. Governing Law

These Terms and any dispute arising from them shall be governed by and interpreted in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction, except where applicable consumer legislation provides otherwise.
